Case notes – NHS matron recovers damages for occupational stress

This case study by solicitor Richard Edwards explores how a senior NHS Matron (C),
already struggling with mental health challenges linked to childhood trauma and
personal stress, was required to take on significantly increased responsibilities at
work, despite occupational health advice to the contrary. The Trust’s failure to heed
the concerns of the Matron, support her properly, or reasonably manage her
workload led to a serious deterioration in her mental health, eventually resulting in
her permanent departure from the NHS. Legal proceedings followed, culminating in a
£200,000 settlement. The case highlights the critical need for employer sensitivity to
expressed mental health concerns and to adhere to appropriate occupational health
guidance in the workplace.
