Handling Judicial Criticism: Insights from the Expert Witness Institute Podcast

The Expert Witness Institute provides regular podcasts of interest to expert witnesses. In the February edition the programme looked at how experts obtain feedback and how they can deal with judicial criticism.
The programme looks at the effect of the recent High Court decision in JSC Commercial Bank V Kolomoisky, which Richard previously addressed in an article published by the Law Society Gazette.
The programme is full of useful tips for expert witnesses to enable them to make sure they are aware of criticism or adverse judicial comment. This is particularly important because the line of travel is in favour of experts disclosing criticism voluntarily. A failure to do so can lead to charges that the expert has not given full disclosure, thus potentially damaging the case of the instructing party.
